Coram: McLachlin C.J. and Major, Bastarache, Binnie, LeBel, Deschamps, Fish, Abella and Charron JJ.
The appeal from the judgment of the Court of Appeal of Alberta (Edmonton), Number 0103‑0394‑A3, dated August 27, 2003, heard on January 14, 2005 is allowed on the count for counselling fraud and a new trial is ordered on that count, Major, Abella and Charron JJ., dissenting. The appeal is dismissed in relation to the three remaining counts.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Edmonton), numéro 0103‑0394‑A3, en date du 27 août 2003, entendu le 14 janvier 2005 est accueilli en ce qui a trait au chef d’accusation concernant l’infraction d’avoir conseillé une fraude et la tenue d’un nouveau procès est ordonnée à cet égard. Les juges Major, Charron et Abella sont dissidents. L’appel est rejeté en ce qui concerne les trois autres chefs d’accusation.
