The appeal from the judgment of the Federal Court of Appeal, Number A‑1‑02, dated November 28, 2002, heard on October 13, 2004 is allowed without costs.
The constitutional question is answered as follows:
Q. Is the Canadian Human Rights Act, R.S.C. 1985, c. H-6, constitutionally inapplicable as a consequence of parliamentary privilege to the House of Commons and its members with respect to parliamentary employment matters?
A. Given the broad terms in which this question is put, the answer is No. The definition of a more limited category of privilege, and the extent to which it may provide immunity from the Canadian Human Rights Act, if at all, must await a case in which the question truly arises for a decision.
L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A‑1‑02, en date du 28 novembre 2002, entendu le 13 octobre 2004 est accueilli sans dépens.
La question constitutionnelle reçoit la réponse suivante :
Q. La Loi canadienne sur les droits de la personne, L.R.C. (1985), ch. H-6, est-elle, du fait d’un privilège parlementaire, constitutionnellement inapplicable à la Chambre des communes et à ses membres en ce qui a trait aux relations de travail au Parlement?
R. La question étant posée en termes très larges, nous y répondons par la négative. Pour définir une catégorie de privilège parlementaire plus restreinte, et établir dans quelle mesure un tel privilège peut, le cas échéant, offrir une immunité contre l’application de la Loi canadienne sur les droits de la personne, il faudra attendre que la question se pose véritablement dans le cadre d’un autre pourvoi.

L’arrêt de la Cour d’appel du Québec est infirmé et le jugement de la Cour supérieure du Québec rejetant l’objection de l’intimée est rétabli.
The appeal from the judgment of the Court of Appeal of Quebec (Montréal), Number 500‑09‑013280‑037, dated September 26, 2003, heard on January 13, 2005, is allowed with costs. The judgment of the Quebec Court of Appeal is set aside and the judgment of the Superior Court of Quebec dismissing the respondent’s objection is restored.

The appeal from the judgment of the Court of Appeal for Ontario, Number C38572, dated June 30, 2003, heard on January 13, 2005 is allowed and the order imposing a sentence of incarceration is stayed, Deschamps and Fish JJ. dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C38572, en date du 30 juin 2003, entendu le 13 janvier 2005 est accueilli et l’effet de l’ordonnance prévoyant une peine d’incarcération est suspendu indéfiniment. Les juges Deschamps et Fish sont dissidents.
