The appeal from the judgment of the Saskatchewan Court of Appeal, Number 336, dated December 2, 2002, heard on December 13, 2004, is allowed in part, with costs, Bastarache, LeBel, Deschamps and Charron JJ. dissenting in part. The trial judge’s award of pecuniary damages for loss of past earnings is restored but reduced to reflect the time the appellant spent in prison and the social assistance he received during the period covered by the award. In the absence of an agreement between the parties as to the amounts involved, they are to be fixed on an application by either party to the trial court. The appeal should be dismissed with respect to the trial judge’s award of damages for loss of future earnings.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Saskatchewan, numéro 336, en date du 2 décembre 2002, entendu le 13 décembre 2004, est accueilli en partie, avec dépens. Les juges Bastarache, LeBel, Deschamps et Charron sont dissidents en partie. Les dommages‑intérêts pécuniaires accordés par le juge de première instance pour la perte de revenus antérieure sont rétablis, mais ils doivent être réduits pour tenir compte du temps que l’appelant a passé en prison et des prestations d’aide sociale qu’il a touchées au cours de la période considérée. À défaut d’une entente entre les parties, les montants en cause devront être fixés sur demande présentée au tribunal de première instance par l’une ou l’autre des parties. L’appel est rejeté en ce qui concerne les dommages‑intérêts accordés par le juge de première instance pour la perte de revenus ultérieure.
