The appeal from the judgment of the Nova Scotia Court of Appeal, Number CA 178590, dated March 12, 2003, heard on November 2, 2004, is allowed and the decision of the trial judge is affirmed, with costs to the appellants throughout, Bastarache and Charron JJ. dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Nouvelle‑Écosse, numéro CA 178590, en date du 12 mars 2003, entendu le 2 novembre 2004, est accueilli et la décision du juge de première instance est confirmée, avec dépens en faveur des appelants dans toutes les cours. Les juges Bastarache et Charron sont dissidents.
