The appeal from the judgment of the Court of Appeal for Ontario, Numbers C40873 and C40874, dated September 16, 2004, heard on December 12, 2005 is allowed, LeBel, Deschamps and Abella JJ. dissenting. The case is remitted to the Social Benefits Tribunal so that it can rule on the applicability of s. 5(2) of the Ontario Disability Support Program Act, 1997, S.O. 1997, c. 25, Sch. B. The appellants’ request for reimbursement of their disbursements before this Court is granted.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéros C40873 et C40874, en date du 16 septembre 2004, entendu le 12 décembre 2005 est accueilli, les juges LeBel, Deschamps et Abella sont dissidents. L’affaire est renvoyée au Tribunal de l’aide sociale pour qu’il se prononce sur la question de l’applicabilité du par. 5(2) de la Loi de 1997 sur le Programme ontarien de soutien aux personnes handicapées, L.O. 1997, ch. 25, ann. B. La demande de remboursement des débours devant la Cour présentée par les appelants est accueillie.
