The appeals and cross-appeals from the judgment of the Court of Appeal for Ontario, Numbers C37425, C37426, C37427, C37429, C37444, C38228, C38229, C38241, dated January 20, 2004, and the appeals from the judgments of the Court of Appeal of Quebec, Numbers 500-09-010326-007, 500-09-010334-001, 500-09-010343-002, 500-09-010344-000, 500-09-010336-006, 500-09-010335-008, 500-09-010328-003, 500-09-010337-004, 500-09-010338-002, 500-09-010333-003, 500-09-010341-006 and 500-09-010339-000, dated November 15, 2004, heard on January 16 and 17, 2006, are decided as follows:
1. The appeals of NAV Canada seeking to hold the respondents liable in their personal/corporate capacity are dismissed;
2. The appeals of NAV Canada and the airport authorities of the dismissal of their seizure and detention applications are allowed and those applications remitted to the respective motions judges to be dealt with in accordance with the reasons of this Court;
3. The orders requiring NAV Canada and the airport authorities to reimburse the respondents for the aircraft detention costs are set aside;
4. The appeals of NAV Canada and the Greater Toronto Airports Authority of the ruling that the engine lessors are entitled to repossess the leased engines are allowed.
In other respects, the appeals and cross-appeals are dismissed. Costs are awarded to the appellants in this Court and in the courts below.
Les appels et appels incidents interjetés contre l’arrêt de la Cour d’appel de l’Ontario, numéros C37425, C37426, C37427, C37429, C37444, C38228, C38229, C38241, en date du 20 janvier 2004, et les appels contre les arrêts de la Cour d’appel du Québec, numéros 500-09-010326-007, 500-09-010334-001, 500-09-010343-002, 500-09-010344-000, 500-09-010336-006, 500-09-010335-008, 500-09-010328-003, 500-09-010337-004, 500-09-010338-002, 500-09-010333-003, 500-09-010341-006 et 500-09-010339-000, en date du 15 novembre 2004, entendus les 16 et 17 janvier 2006, sont tranchés de la manière suivante :
1. Les appels de NAV Canada visant à faire reconnaître la responsabilité personnelle des intimées sont rejetés;
2. Les appels formés par NAV Canada et les administrations aéroportuaires contre le rejet de leurs demandes de saisie et de rétention sont accueillis et ces demandes sont renvoyées aux juges des requêtes respectifs pour qu’ils les tranchent conformément aux motifs de cette Cour;
3. Les ordonnances enjoignant NAV Canada et les administrations aéroportuaires de défrayer les intimées des coûts afférents à la rétention des aéronefs sont annulées;
4. Les appels formés par NAV Canada et la Greater Toronto Airports Authority contre la décision portant que les locateurs de moteurs ont le droit de reprendre possession des moteurs loués sont accueillis.
Pour le reste, les appels et appels incidents sont rejetés. Les appelantes ont droit aux dépens devant notre Cour et les juridictions inférieures.
