The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA030787, 2004 BCCA 80, 2004 BCCA 282, dated May 18, 2004, heard on November 15, 2005, is allowed.
The order of the Court of Appeal is set aside, with the exception of the order as to costs, which is affirmed. Rogers Communications Incorporated is ordered to pay National Trust Company’s costs in this Court.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‐Britannique (Vancouver), numéro CA030787, 2004 BCCA 80, 2004 BCCA 282, en date du 18 mai 2004, entendu le 15 novembre 2005, est accueilli.
L’ordonnance de la Cour d’appel est annulée, sauf l’ordonnance relative aux dépens qui est confirmée. Il est ordonné à Rogers Communications inc. de payer les dépens de la Compagnie Trust National devant notre Cour.
