31350 Leaka Helena Delia Dickie v. Kenneth Earle Dickie - and - Women’s Legal Education and Action Fund (Ont.) (Civil) (By Leave) 2007 SCC 8 / 2007 CSC 8
Coram: McLachlin C.J. and Bastarache, Binnie, LeBel, Deschamps, Fish, Abella, Charron and Rothstein JJ.
The appeal from the judgment of the Court of Appeal for Ontario, Numbers C41501, C41563, dated January 13, 2006, heard on January 17, 2007, is allowed, the order of the Court of Appeal is set aside, Dr. Dickie’s appeal from the contempt order is dismissed and the motions judge’s order reinstated. Mrs. Dickie is awarded her costs before this Court on a solicitor and client basis and in the Court of Appeal on a substantial indemnity basis.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéros C41501, C41563, en date du 13 janvier 2006, entendu le 17 janvier 2007, est accueilli, l’ordonnance de la Cour d’appel est annulée, l’appel du Dr Dickie contre sa condamnation pour outrage est rejeté et l’ordonnance de la juge des motions est rétablie. Madame Dickie aura droit à ses dépens devant notre Cour sur la base procureur-client et devant la Cour d’appel sur une base d’indemnisation substantielle.
