The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA031054, dated April 8, 2005, heard on May 15, 2006, is dismissed and the order for a new trial is confirmed. Bastarache, Deschamps, Abella and Rothstein JJ. are dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA031054, en date du 8 avril 2005, entendu le 15 mai 2006, est rejeté et l’ordonnance commandant la tenue d’un nouveau procès est confirmée. Les juges Bastarache, Deschamps, Abella et Rothstein sont dissidents.
