Charter – Civil – Freedom of expression – Whether there are divergent approaches for evaluating freedom of expression claims under s. 2(b) of the Charter considering this Court’s decisions in Irwin Toy v. Quebec (Attorney General) and Haig v. Canada (Chief Electoral Officer) – Whether ss. 1(2)(a) and (b) of the School Trustee Statutes Amendment Act, 2002 infringe the Appellants’ freedom to engage in political expression as guaranteed under s. 2(b) of the Charter – Whether ss. 1(2)(a) and (b) of the School Trustee Statutes Amendment Act, 2002 infringe s. 15 of the Charter on the analogous ground of occupational status - If so, whether the infringement is a reasonable limit pursuant to s. 1 of the Charter.
The Respondent, the Province of Alberta, enacted amendments to the Local Authorities Election Act, R.S.A. 2000, c. L-21 which had the effect of precluding school board employees from seeking election to any school board in Alberta while employed by a school board. Prior to these amendments, school board employees were only precluded from seeking election to the school board that employed them. The Appellants are teachers who wish to seek election to a school board without resigning their employment. They applied for a declaration that the amendments were of no force and effect because they infringed ss. 2(b) and 15(1) of the Canadian Charter of Rights and Freedoms. Sulyma J. granted an order that the amendments were contrary to s. 2(b) of the Charter. On appeal, the Respondent’s appeal was allowed.

Charte – Civile – Liberté d’expression – Y a-t-il des approches divergentes pour évaluer des revendications de liberté d’expression fondées sur l’al. 2b) de la Charte étant données les décisions de la Cour dans Irwin Toy c. Québec (Procureur général) et Haig c. Canada (Directeur général des élections)? – Les alinéas 1(2)(a) et (b) de la loi intitulée School Trustee Statutes Amendment Act, 2002 portent-ils atteinte à la liberté d’expression politique garantie aux appelants par l’al. 2b) de la Charte? – Ces dispositions portent-elles atteinte à l’art. 15 de la Charte pour un motif analogue fondé sur le statut professionnel? - Dans l’affirmative, cette atteinte constitue-t-elle une limite raisonnable au sens de l’article premier de la Charte?
L’intimée, la province d’Alberta, a apporté à la loi intitulée Local Authorities Election Act, R.S.A. 2000, ch. L-21, des modifications qui avaient pour effet d’interdire aux employés de conseils scolaires de se porter candidats à un poste de conseiller scolaire partout en Alberta pendant qu’ils occupaient leur emploi. Avant l’édiction de ces modifications, il leur était interdit de briguer le poste de conseiller scolaire uniquement dans le conseil scolaire où ils occupaient un emploi. Les appelants sont des enseignants qui souhaitent se porter candidats pour un poste de conseiller scolaire sans avoir à quitter leur emploi. Ils ont demandé un jugement déclarant les modifications inopérantes parce qu’elles contreviennent à l’al. 2b) et au par. 15(1) de la Charte. La juge Sulyma a rendu une ordonnance portant que les modifications contrevenaient à l’al. 2b) de la Charte. L’appel formé par l’intimée contre cette décision a été accueilli.
