Canadian Charter - Criminal - Criminal Law - Detention - Evidence - Roadblocks to investigate and prevent crime - Whether the common law authorizes, and the Charter permits, the police to set up a roadblock to fulfill their statutory and common law duties, including to protect life and ensure safety, and, if so, in what circumstances - If so, does the common law also authorize, and the Charter permit, a "protective search" of people detained and a search of motor vehicles stopped at the roadblock and, if so, in what circumstances - If so, were these powers properly exercised in this case? - If the answers are no, does s. 24(2) of the Charter permit a consideration, on the basis of no evidence, of an “institutional failure” of police service to train its officers on the ancillary powers doctrine as a rationale for exclusion.
Police responded to a gun call alerting them that about ten men had been seen in a parking lot and four were carrying illegal handguns. The dispatcher described four cars associated with the men. The club’s parking lot had only two exits. Two constables blocked the rear exit of the parking lot. Troy Farmer and Wendell Clayton approached the roadblock in Farmer’s vehicle. His car did not match the vehicle descriptions given to the police. Farmer and Clayton were stopped, questioned and removed from Farmer’s vehicle. Clayton fled and was apprehended. Both men were arrested, searched, and found to be carrying handguns. The Court of Appeal held that a roadblock is a profound interference with the individual liberties of an indeterminate number of people and may only be used to investigate and prevent crime if there are reasonable grounds to suspect that a serious crime has been committed and a roadblock may apprehend the perpetrator and allowed the appeals against conviction.

Charte canadienne - Criminel - Droit criminel - Détention - Preuve - Barrages routiers pour enquêter sur les crimes et les prévenir - La common law et la Charte autorisent-elles les policiers à installer un barrage routier pour s’acquitter des fonctions qui leur incombent en vertu des lois et de la common law, notamment pour protéger la vie et assurer la sécurité - Si oui, dans quelles circonstances l’autorisent-elles ? - Dans l’affirmative, la common law et la Charte autorisent-elles également une « fouille protectrice » des personnes détenues et une fouille des véhicules automobiles immobilisés au barrage routier et, si oui, dans quelles circonstances ? - Dans l’affirmative, ces pouvoirs ont-ils été exercés régulièrement en l’espèce ? - Dans la négative, le par. 24(2) de la Charte permet-il de tenir compte, en l’absence d’éléments de preuve, d’une « omission institutionnelle » du service de police de former ses agents quant à la doctrine des pouvoirs accessoires comme fondement d’une exclusion?
La police a répondu à un appel relatif à des coups de feu l’informant qu’environ dix hommes avaient été vus dans un stationnement et que quatre d’entre eux portaient des armes de poing illégales. Le répartiteur a donné la description de quatre automobiles reliées aux hommes. Le stationnement du club n’avait que deux sorties. Deux agents ont bloqué la sortie arrière. Troy Farmer et Wendell Clayton se sont approchés du barrage routier dans la voiture de Farmer, qui ne correspondait pas aux descriptions de véhicules données à la police. Farmer et Clayton ont été interceptés, sont sortis du véhicule de Farmer et ont été questionnés. Clayton s’est enfui et a été appréhendé. Les deux hommes ont été arrêtés et fouillés, et on a trouvé des armes de poing sur eux. La Cour d’appel a statué qu’un barrage routier constitue une grave atteinte aux libertés individuelles d’un nombre indéterminé de personnes et ne peut être utilisé pour prévenir les crimes ou enquêter sur de tels événements que s’il existe des motifs raisonnables de soupçonner qu’un crime grave a été commis et que le barrage permettra d’appréhender son auteur et a accueilli les appels des déclarations de culpabilité.
