The appeal from the judgment of the Federal Court of Appeal, Number A‑149‑05, 2006 FCA 107, dated March 15, 2006, heard on May 24, 2007, is allowed, the judgment of the Federal Court of Appeal is set aside and the judgment of the motions judge is restored, with costs.

L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A‑149‑05, 2006 CAF 107, en date du 15 mars 2006, entendu le 24 mai 2007, est accueilli, le jugement de la Cour d’appel fédérale est infirmé et le jugement du juge des requêtes est rétabli, avec dépens.
