L'appel interjeté contre l'arrêt de la Cour d'appel de la Nouvelle‐Écosse, numéro CAC 266318, en date du 31 janvier 2007, entendu le 25 janvier 2008 est accueilli, le jugement de la Cour d'appel est infirmé et la déclaration de culpabilité est rétablie.

L'appel interjeté contre l'arrêt de la Cour d'appel du Québec (Montréal), numéro 500‐10‐003351‐051, en date du 26 mai 2006, entendu le 14 novembre 2007, est accueilli, le jugement de la Cour d'appel est cassé, et la sentence prononcée par la Cour du Québec est rétablie. Le juge Fish est dissident.
The appeal from the judgment of the Court of Appeal of Quebec (Montréal), Number 500‐10‐003351‐051, dated May 26, 2006, heard on November 14, 2007, is allowed, the judgment of the Court of Appeal is set aside and the sentence imposed by the Court of Québec is restored. Fish J. is dissenting.
