Criminal law - Offences - Elements of offence - Classification of death as first degree murder irrespective of planning and deliberation if death caused while committing robbery - Meaning of forcible confinement in s. 231(5)(e) of the Criminal Code - Whether trial judge instructed the jury correctly on forcible confinement for the purposes of s. 231(5)(e) of the Criminal Code - Whether confinement alleged to have occurred in course of a robbery constitutes forcible confinement for the purpose of classifying a death as first degree murder under s. 231(5)(e).
The Appellant was tried before a jury for the murder of Pirkko Skolos. The Crown argued that the Appellant killed Skolos while robbing a large quantity of marijuana. The Crown sought a conviction for first degree murder. The trial judge held that there was not enough evidence of planning and deliberation to direct a verdict on first degree murder but a jury might find that Skolos’ death was first degree murder under s. 231(5)(e) because it was caused by the Appellant while he was committing forcible confinement. The Appellant was convicted of first degree murder. On appeal, the Court of Appeal dismissed the appeal.

Droit criminel - Infractions - Éléments constitutifs des infractions - Classification d’un homicide comme meurtre au premier degré indépendamment de toute préméditation si la mort est causée au cours d’un vol qualifié - Sens du terme « séquestration » employé à l’al. 231(5)e) du Code criminel - Le juge du procès a‑t‑il donné au jury des directives appropriées au sujet de la séquestration pour l’application de l’al. 231(5)e) du Code criminel? - La séquestration qui serait survenue au cours d’un vol qualifié équivaut‑t‑elle à une séquestration au sens de l’al. 231(5)e) pour les besoins de la classification de l’homicide comme meurtre au premier degré?
L’appelant a subi son procès devant juge et jury pour le meurtre de Pirkko Skolos. Le ministère public a fait valoir que l’appelant a tué Skolos en volant une grande quantité de marijuana. Il a demandé une déclaration de culpabilité pour meurtre au premier degré. Le juge du procès a conclu qu’il y avait trop peu de preuve de préméditation pour ordonner l’inscription d’un verdict de culpabilité de meurtre au premier degré, mais qu’un jury pouvait conclure que la mort de Skolos était un meurtre au premier degré par application de l’al. 231(5)e) parce que l’appelant l’a causée en séquestrant la victime. L’appelant a été reconnu coupable de meurtre au premier degré. La Cour d’appel a rejeté son appel.

Criminal law - Manslaughter - Whether conviction for manslaughter by criminal negligence causing death was inconsistent with acquittal for manslaughter by failure to provide the necessaries of life causing death - Whether the Ontario Court of Appeal erred in law by ordering a new trial for the accused instead of entering a verdict of acquittal.
On April 15, 2000, K.M. came into the foster care of the Respondent and his wife. On June 20, 2000, K.M. was pronounced dead at the Sandy Lake Nursing Station after efforts to revive him failed. K.M. was four years old at the time of his death. Blunt force trauma to the head was the cause of death. Bruising on the boy’s body suggested that he had suffered abuse in the days before his death.
Both the Respondent and his wife were charged in relation to K.M.’s death. On November 29, 2004, the Respondent’s wife pleaded guilty to manslaughter. The Respondent was charged with two counts of manslaughter by unlawful act, the first by criminal negligence and the second by failing to provide the necessaries of life. At trial, a jury found the Respondent guilty on the first count (manslaughter by criminal negligence) and acquitted him on the second count (manslaughter by failing to provide the necessaries of life). On appeal, the majority of the Court of Appeal allowed the appeal. Lang J.A., dissenting, would have dismissed the appeal because the verdicts could not be said to be inconsistent because there are material differences in the constituent elements of the two offences and the trial judge’s instructions to the jury on those differences are not impugned.

Droit criminel ‑ Homicide involontaire coupable ‑ La condamnation pour homicide involontaire coupable résultant de la négligence criminelle entraînant la mort était‑elle incompatible avec l’acquittement relativement à l’accusation d’homicide involontaire coupable résultant de l’omission de fournir les choses nécessaires à l’existence entraînant la mort? ‑ La Cour d’appel de l’Ontario a‑t‑elle eu tort d’ordonner un nouveau procès pour l’accusé au lieu d’inscrire un verdict d’acquittement?
Le 15 avril 2000, K.M. a été placé en famille d’accueil chez l’intimé et son épouse. Le 20 juin 2000, le décès de K.M. a été constaté au Sandy Lake Nursing Station après l’échec des tentatives de réanimation. K.M. avait quatre ans au moment de son décès. Le décès a été provoqué par un traumatisme fermé à la tête. Des ecchymoses au corps du garçon portaient à croire qu’il avait été battu dans les jours précédant son décès.
L’intimé et son épouse ont été accusés relativement au décès de K.M. Le 29 novembre 2004, l’épouse de l’intimé a plaidé coupable à une accusation d’homicide involontaire coupable. L’intimé a été accusé sous deux chefs d’accusation, un d’homicide involontaire coupable résultant de la négligence criminelle entraînant la mort et un d’homicide involontaire coupable résultant de l’omission de fournir les choses nécessaires à l’existence. Au procès, un jury a déclaré l’intimé coupable relativement au premier chef (homicide involontaire coupable résultant de la négligence criminelle entraînant la mort) et l’a acquitté relativement au deuxième chef (homicide involontaire coupable résultant de l’omission de fournir les choses nécessaires à l’existence). En appel, les juges majoritaires ont accueilli l’appel. Le juge Lang, dissident, aurait rejeté l’appel au motif qu’on ne pouvait affirmer que les verdicts sont incompatibles parce que les éléments constitutifs des deux infractions comportent des différences importantes et les directives du juge au jury relativement à ces différences ne sont pas attaquées.
