The appeal from the judgment of the Court of Appeal for Ontario, Number C43783, 2008 ONCA 383, dated May 14, 2008, heard on January 13, 2009, is allowed, the respondent’s convictions are restored and the matter of the sentence is remitted to the Court of Appeal for full consideration. Binnie, Fish, Charron and Cromwell JJ. are dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C43783, 2008 ONCA 383, en date du 14 mai 2008, entendu le 13 janvier 2009, est accueilli, les déclarations de culpabilité de l’intimé sont rétablies et la question de la peine est renvoyée pour examen à la Cour d’appel. Les juges Binnie, Fish, Charron et Cromwell sont dissidents.
