The Respondents sought to purchase space for advertisements of a political nature on the outside of the Appellants’ buses. Their requests were denied on the basis of the Appellants’ advertising policies, which permit commercial advertising on the outside of transit vehicles, but prohibit political advertising and advertising “likely to cause offence to any person or group of persons or create controversy”. The Respondents brought an action seeking, inter alia, a declaration that certain aspects of the policies infringed their right to freedom of expression under s. 2(b) of the Canadian Charter of Rights and Freedoms, and that this infringement could not be justified under s. 1. The Respondents’ application for declaratory relief was dismissed. On appeal, the majority of the Court of Appeal allowed the appeal.

Les intimées ont demandé à acheter de l’espace en vue de faire paraître de la publicité de nature politique sur l’extérieur des autobus des appelantes. Leurs demandes ont été refusées en application des politiques publicitaires des appelantes, qui permettent la publicité commerciale sur l’extérieur des véhicules de transport en commun, mais interdisent la publicité politique et la publicité [traduction] « susceptible de blesser des personnes ou des groupes de personnes ou de susciter des controverses ». Les intimées ont intenté une action sollicitant, notamment, un jugement déclaratoire portant que certains aspects des politiques visées portent atteinte au droit à la liberté d’expression que leur garantit l’al. 2b) de la Charte canadienne des droits et libertés, et que cette atteinte ne peut être justifiée en vertu de l’article premier. L’action en jugement déclaratoire des intimées a été rejetée. En appel, la Cour d’appel a fait droit, à la majorité, à l’appel qui avait été interjeté.
