The appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 0601-0134-AC, 2007 ABCA 160, dated May 17, 2007, heard on October 7, 2008, is allowed, LeBel, Fish and Abella JJ. dissenting.
The constitutional questions are answered as follows:
1. Does s. 14(1)(b) of Alberta’s Operator Licensing and Vehicle Control Regulation, Alta. Reg. 320/2002, as amended by Alta. Reg. 137/2003, infringe s. 2(a) of the Canadian Charter of Rights and Freedoms?
Answer: Yes.
2. If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: Yes. LeBel, Fish and Abella JJ. would answer no.
3. Does s. 14(1)(b) of Alberta’s Operator Licensing and Vehicle Control Regulation, Alta. Reg. 320/2002, as amended by Alta. Reg. 137/2003, infringe s. 15(1) of the Canadian Charter of Rights and Freedoms?
Answer: No. LeBel, Fish and Abella JJ. find it unnecessary to answer this question.
4. If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: It is not necessary to answer this question.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Calgary), numéro 0601-0134-AC, 2007 ABCA 160, en date du 17 mai 2007, entendu le 7 octobre 2008, est accueilli. Les juges LeBel, Fish et Abella sont dissidents.
Les questions constitutionnelles reçoivent les réponses suivantes :
1. L’alinéa 14(1)b) du règlement 320/2002 de l’Alberta intitulé Operator Licensing and Vehicle Control Regulation, modifié par le règlement 137/2003 de l’Alberta, porte‑t‑il atteinte aux droits garantis à l’al. 2a) de la Charte canadienne des droits et libertés?
Réponse : Oui.
2. Dans l’affirmative, les droits sont‑ils restreints par une règle de droit, dans des limites qui soient raisonnables et dont la justification puisse se démontrer dans une société libre et démocratique, au sens de l’article premier de la Charte canadienne des droits et libertés?
Réponse : Oui. Les juges LeBel, Fish et Abella répondraient non.
3. L’alinéa 14(1)b) du règlement 320/2002 de l’Alberta intitulé Operator Licensing and Vehicle Control Regulation, modifié par le règlement 137/2003 de l’Alberta, porte‑il atteinte aux droits garantis au par. 15(1) de la Charte canadienne des droits et libertés?
Réponse : Non. Les juges LeBel, Fish et Abella estiment qu’il n’est pas nécessaire de répondre à cette question.
4. Dans l’affirmative, les droits sont‑ils restreints par une règle de droit, dans des limites qui soient raisonnables et dont la justification puisse se démontrer dans une société libre et démocratique, au sens de l’article premier de la Charte canadienne des droits et libertés?
