Criminal law ‑ Charge to jury ‑ Whether trial judge erred in law by failing to warn jury against impermissible propensity reasoning ‑ Whether the trial judge erred in law in dismissing the Appellant’s application for severance.
Two complainants testified that the Appellant attacked and repeatedly sexually assaulted them in separate, unrelated incidents. S.M. testified that the Appellant threatened her with a gun, repeatedly sexually assaulted her and repeatedly choked her until she was unconscious. M.A. testified that the Appellant struck her in the forehead with an empty tea mug, choked her into unconsciousness and repeatedly sexually assaulted her. The Appellant was charged in one indictment with multiple offences relating to both assaults. He brought a motion for severance but the motion was denied. In his charge to the jury, the trial judge did not instruct the jury not to engage in propensity reasoning.
The Appellant was convicted of one count of sexual assault with a weapon (a handgun), one count of aggravated sexual assault, two counts of overcoming resistance by choking, and two counts of breach of undertaking. All counts in the indictment, other than the counts relating to breach of undertaking, arose from the two alleged sexual assaults. On appeal, the majority of the Court of Appeal dismissed the appeals as to conviction and sentence. Juriansz J.A. dissenting would have allowed the appeal, set the convictions aside and remitted the matter to the Superior Court for the two counts to be retried separately.

Droit criminel ‑ Directives au jury ‑ Le juge du procès a‑t‑il commis une erreur de droit en ne prévenant pas le jury du caractère inacceptable du raisonnement fondé sur la propension? ‑ Le juge du procès a‑t‑il commis une erreur de droit en rejetant la demande de séparation des chefs d’accusation présentée par l’appelant?
Selon les deux plaignantes, les agressions sexuelles répétées dont elles ont été victimes constituent des incidents distincts qui ne sont pas reliés. Dans sa déposition, S.M. a dit que l’appelant l’avait menacée avec une arme à feu, agressée sexuellement à maintes reprises et étouffée de façon répétée jusqu’à ce qu’elle perde connaissance. Quant à M.A., elle a déclaré que l’appelant l’avait frappée au front avec une tasse à thé vide, étouffée jusqu’à ce qu’elle perde connaissance et agressée sexuellement à maintes reprises. L’appelant a été inculpé, par mise en accusation unique, de plusieurs infractions se rapportant aux deux agressions. Il a présenté une demande de séparation des chefs d’accusation, qui a été rejetée. Dans son exposé au jury, le juge du procès ne lui a pas donné la directive d’éviter le raisonnement fondé sur la propension.
L’appelant a été déclaré coupable sous un chef d’agression sexuelle armée (commise avec une arme à feu), un chef d’agression sexuelle grave, deux chefs d’avoir vaincu la résistance par l’étouffement et deux chefs d’omission de se conformer à une condition d’une promesse. Tous les chefs de la mise en accusation, à l’exception des chefs relatifs à l’omission de se conformer à une condition d’une promesse, découlaient des deux agressions sexuelles alléguées. Les juges majoritaires de la Cour d’appel ont rejeté les appels de la déclaration de culpabilité et de la peine. Le juge Juriansz, dissident, aurait accueilli l’appel, annulé les déclarations de culpabilité et renvoyé l’affaire à la Cour supérieure pour que les deux chefs soient jugés dans des procès séparés.
