The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Numbers CA035614, CA035615, CA035616, 2008 BCCA 892, dated July 10, 2008, heard on April 22, 2009, is allowed and the cross-appeal is dismissed. The case is returned to the trial court to be proceeded with in accordance with the judgment of the Court in this case.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie-Britannique (Vancouver), numéros CA035614, CA035615, CA035616, 2008 BCCA 892, en date du 10 juillet 2008, entendu le 22 avril 2009 est accueilli et l’appel incident est rejeté. L’affaire est renvoyée au tribunal de première instance pour qu’elle y soit instruite conformément au jugement de la Cour en l’espèce.
