L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA033983, 2007 BCCA 592, en date du 3 décembre 2007, entendu le 23 mars 2009, est accueilli, l’ordonnance de la Cour d’appel est annulée et le jugement de première instance est rétabli. La juge en chef McLachlin et les juges Binnie, Abella et Rothstein sont dissidents.
