The appeal from the judgment of the Court of Appeal for Ontario, Number C42156, 2007 ONCA 392, dated May 25, 2007, heard on December 11, 2008, is allowed. The decision of the Court of Appeal is set aside and the Assistant Commissioner’s order confirming the constitutionality of s. 23 of the Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. F.31, is restored. The documents protected by s. 19 of the Act are exempted from disclosure. The claim under s. 14 of the Act is returned to the Commissioner for reconsideration.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C42156, 2007 ONCA 392, en date du 25 mai 2007, entendu le 11 décembre 2008, est accueilli. La décision de la Cour d’appel est annulée et l’ordonnance du commissaire adjoint confirmant la constitutionnalité de l’art. 23 de la Loi sur l’accès à l’information et la protection de la vie privée, L.R.O. 1990, ch. F.31, est rétablie. Les documents protégés par l’art. 19 de la Loi sont soustraits à la divulgation. L’ordonnance relative à la demande visée par l’art. 14 de la Loi est renvoyée au commissaire pour réexamen.
