Charter of Rights ‑ Remedies ‑ Damages ‑ Whether s. 24(1) of the Canadian Charter of Rights and Freedoms authorizes a court of competent jurisdiction to award damages for an infringement of a right or freedom guaranteed by the Charter in the absence of bad faith, an abuse of power or tortious conduct committed by the infringer.
During Prime Minister Chrétien’s 2002 opening of the Millennium Gate in Vancouver’s Chinatown, police received a report that a man was overheard planning to throw a pie at the Prime Minister. The Respondent fit the suspect’s description in some respects, and was picked up by police as he was allegedly running down the street. The Respondent was allegedly loud in protesting his detention, attracting much attention. While initially detained for investigation of assault or attempted assault, he was arrested for breach of the peace. He was handcuffed and taken by paddy wagon to jail, and his car was seized. While at the lockup, the Respondent was strip searched by corrections officers. He was released four and a half hours after his arrest and was never charged. The Respondent brought an action against the Appellants seeking declarations that his Charter rights under ss. 7, 8 and 9 had been infringed, and seeking damages. He alleged that his treatment constituted assault, battery, false imprisonment, and negligence and included the police officers and corrections officers as defendants.

Charte des droits ‑ Recours ‑ Dommages‑intérêts ‑ Le paragraphe 24(1) de la Charte canadienne des droits et libertés habilite‑til un tribunal compétent à accorder des dommages intérêts pour atteinte à un droit ou à une liberté garanti par la Charte en l’absence de mauvaise foi, d’abus de pouvoir ou de conduite délictuelle de la part de l’auteur de l’atteinte?
Pendant que le premier ministre Chrétien participait à l’inauguration, en 2002, du Millennium Gate dans le quartier chinois de Vancouver, les policiers ont été informés qu’un homme s’apprêtait à l’entarter. L’intimé correspondait à la description du suspect à certains égards et il a été appréhendé par les policiers alors que, prétendument, il courait dans la rue. L’intimé aurait protesté bruyamment contre sa mise en détention, ce qui a attiré beaucoup d’attention. Alors qu’il a été initialement détenu aux fins d’enquête pour voies de fait ou tentative de voies de fait, il a été arrêté pour violation de la paix. On lui a passé les menottes, il a été conduit en prison à bord d’un panier à salade et sa voiture a été saisie. Au lieu de détention, l’intimé a été fouillé à nu par des agents de correction. Il a été libéré quatre heures et demie après son arrestation et n’a jamais été accusé. L’intimé a intenté une action contre les appelantes pour obtenir un jugement déclaratoire confirmant la violation de ses droits garantis par les art. 7, 8 et 9 de la Charte et des dommages‑intérêts. Il a allégué que le traitement qui lui avait été infligé constituait des délits de voies de fait, batterie, séquestration et négligence et il a inclus les policiers et les agents de correction comme défendeurs.
