The appeal from the judgment of the Court of Appeal for Ontario, Number C44742, 2008 ONCA 394, dated May 20, 2008, heard on May 18, 2010, is dismissed with costs on a solicitor-and-client basis in this Court, including costs of the leave application, to be paid to both parties out of the trust fund.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C44742, 2008 ONCA 394, en date du 20 mai 2008, entendu le 18 mai 2010, est rejeté avec dépens. Les dépens sont accordés aux deux parties sur la base procureur-client devant la Cour, y compris les dépens relatifs à la demande d’autorisation d’appel, et seront prélevés sur la caisse de retraite.
