The appeal from the judgment of the Ontario Superior Court of Justice, Number CRIMJ (F) 2025/07, dated January 15, 2009, heard on March 18, 2010, is allowed.
The constitutional questions are answered as follows:
1. Are ss. 38 to 38.16 of the Canada Evidence Act, R.S.C. 1985, c. C-5, ultra vires the Parliament of Canada on the ground that they infringe ss. 96 and 101 of the Constitution Act, 1867?
Answer: No.
2. Do ss. 38 to 38.16 of the Canada Evidence Act, R.S.C. 1985, c. C-5, infringe s. 7 of the Canadian Charter of Rights and Freedoms?
Answer: No.
3. If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: It is not necessary to answer this question.
L’appel interjeté contre le jugement de la Cour supérieure de justice de l’Ontario, numéro CRIMJ (F) 2025/07, en date du 15 janvier 2009, entendu le 18 mars 2010, est accueilli.
Voici les réponses aux questions constitutionnelles :
1. Les art. 38 à 38.16 de la Loi sur la preuve au Canada, L.R.C. 1985, ch. C-5, outrepassent-ils les pouvoirs du Parlement du Canada du fait qu’ils contreviennent aux art. 96 et 101 de la Loi constitutionnelle de 1867?
Réponse : Non.
2. Les art. 38 à 38.16 de la Loi sur la preuve au Canada, L.R.C. 1985, ch. C-5, contreviennent-ils à l’art. 7 de la Charte canadienne des droits et libertés?
Réponse : Non.
3. Dans l’affirmative, s’agit-il d’une limite raisonnable prescrite par une règle de droit et dont la justification peut se démontrer dans le cadre d’une société libre et démocratique au sens de l’article premier de la Charte canadienne des droits et libertés?
Réponse : Il n’est pas nécessaire de répondre à cette question.
