The appeal is allowed in part as follows. The appeal from the judgment of the Federal Court of Appeal on the respondent’s counterclaim is allowed with costs. However, the respondent may recover its costs in the motion to strike the action in rem and to set aside the arrest. These costs include the $3,806.37 in interest costs incurred as a result of maintaining the $80,000 security. Because success has been divided, costs ordered in the courts below should not otherwise be disturbed.
Le pourvoi est accueilli en partie de la façon suivante. Le pourvoi contre l’arrêt de la Cour d’appel fédérale relativement à la demande reconventionnelle de l’intimée est accueilli, avec dépens. Cependant, l’intimée peut obtenir ses dépens dans la requête en radiation de l’action in rem et en annulation de la saisie. Ces dépens comprennent les frais d’intérêt de 3 806,37 $ engagés pour maintenir le cautionnement de 80 000 $. Comme il y a gain de cause partagé, il n’y a pas lieu de modifier par ailleurs les dépens accordés par les tribunaux d’instance inférieure.
