The appeal is allowed and the order of the New Brunswick Court of Appeal is set aside, Gonthier and Binnie JJ. dissenting. The constitutional question is answered by the majority as follows:
Question: If as a matter of statutory interpretation, the Social Services and Education Tax Act, R.S.N.B. 1973, c. S-10, imposes a tax in respect of tangible personal property purchased at a location off- reserve which is destined for use entirely or primarily by an Indian or an Indian band on a reserve, and further, if as a matter of statutory interpretation, s. 87 of the Indian Act prohibits such taxation, is the Social Services and Education Tax Act rendered inoperative to the extent of its inconsistency with s. 87 of the Indian Act?
Answer: Section 87 of the Indian Act does not prohibit taxation in respect of tangible personal property purchased at a location off- reserve which is destined for use entirely or primarily by an Indian or an Indian band on a reserve. As such, the Social Services and Education Tax Act is not inconsistent with s. 87 of the Indian Act and is not rendered inoperative.
Le pourvoi est accueilli et l’ordonnance rendue par la Cour d’appel du Nouveau-Brunswick est infirmée. Les juges Gonthier et Binnie sont dissidents. Les juges majoritaires donnent à la question constitutionnelle la réponse suivante:
Question: Si, selon les principes de l’interprétation législative, la Loi sur la taxe pour les services sociaux et l’éducation, L.R.N.-B. 1973, ch. s-10, impose une taxe sur les biens meubles corporels acquis à l’extérieur d’une réserve qui sont destinés à être utilisés entièrement ou essentiellement dans une réserve par un Indien ou une bande indienne et que, selon les principes de l’interprétation législative, l’art. 87 de la Loi sur les Indiens interdit une telle taxation, la Loi sur la taxe pour les services sociaux et l’éducation est-elle inopérante dans la mesure de son incompatibilité avec l’art. 87 de la Loi sur les Indiens?
Réponse: L’article 87 de la Loi sur les Indiens n’interdit pas la taxation des biens meubles corporels acquis à l’extérieur d’une réserve qui sont destinés à être utilisés entièrement ou essentiellement dans une réserve par un Indien ou une bande indienne. En tant que telle, la Loi sur la taxe pour les services sociaux et l’éducation n’est pas incompatible avec l’art. 87 de la Loi sur les Indiens et n’est donc pas inopérante.
