The appeal is allowed, the decision of the Federal Court of Appeal is set aside, and that portion of the respondent’s assessment which attributes the dividend income received by Ruby Neuman to the appellant is set aside, with costs throughout.
Le pourvoi est accueilli, l’arrêt de la Cour d’appel fédérale est annulé et la partie de la cotisation de l’intimée qui attribue à l’appelant le revenu de dividendes touché par Ruby Neuman est annulée, avec dépens dans toutes les cours.
