Constitutional law - Indians - Aboriginal law - Taxation - Band assessment and taxation bylaws authorized by s. 83 of the Indian Act, R.S.C. 1985, c. I-5, as amended - Whether the Respondent can claim tax immunity granted by s. 125 of the Constitution Act, 1867 from taxes levied by the Appellant in respect of interests in reserve lands - Whether the Respondent has accepted the burden of s. 83 of the Indian Act when it accepted the benefit of s. 28(2) of the Act.
Tsinstikeptum Indian Reserves No. 9 and 10 on the shores of Lake Okanagan are both reserves of the Westbank Band, Westbank First Nation, the Appellant. The Respondent is the British Columbia Hydro and Power Authority.
In 1971, Her Majesty the Queen in Right of Canada, on behalf of Westbank, entered into an agreement with the Respondent. That agreement granted the Respondent a right-of-way across Reserve No. 9 for electric transmission and distribution lines. The Band consented to the agreement. In 1960, the same parties had made a similar agreement relating to Reserve No. 10, again with the Band’s consent. Both permits for the rights-of-way contained the following provision:
2. THAT the Permittee shall pay and discharge all rates, taxes, duties and assessments which the Permittee as occupier of the Reserve is now or shall hereafter be charged upon or in respect of the works during the continuance of the rights hereby granted.
The Westbank Band Council passed assessment and taxation bylaws, pursuant to s. 83 of the Indian Act, R.S.C. 1985, c. I-5, as amended, effective for the taxation years 1991 through 1995. The Respondent was assessed and taxed for those years and it neither appealed the notices, nor did it pay the taxes assessed. The Appellant sued the Respondent for $124,527.25, which represented the total amount of taxes, penalties and interest calculated to June 30, 1995 and for interest thereafter.
The Appellant applied for judgment pursuant to Rule 18A. The Respondent cross-applied for an order that the claim be dismissed, and for declaratory relief. The Appellant’s claim for unpaid taxes and interest was dismissed. An appeal was also dismissed.

(1985), ch. I-5, et ses modifications - L’intimée peut-elle se prévaloir de l’exemption de taxes prévue à l’article 125 de la Loi constitutionnelle de 1867 pour éviter de payer les taxes imposées par l’appelante sur les droits dans les immeubles situés dans la réserve? - L’intimée a-t-elle accepté le fardeau de l’art. 83 de la Loi sur les Indiens lorsqu’elle a accepté le bénéfice de l’art. 28(2) de la Loi?
Les réserves indiennes Tsinstikeptum nos 9 et 10, sur les rives du lac Okanagan, sont toutes deux des réserves de la bande de Westbank, Première Nation de Westbank, l’appelante. L’intimée est British Columbia Hydro and Power Authority.
En 1971, Sa Majesté la Reine du chef du Canada, pour le compte de Westbank, a conclu avec l’intimée un accord qui accordait à cette dernière un droit de passage sur la Réserve no 9 pour des lignes de transmission et de distribution d’énergie électrique. La bande a consenti à l’accord. En 1960, les mêmes parties concluaient un accord similaire portant sur la Réserve no 10, également avec le consentement de la bande. Les deux dispositions autorisant les droits de passage étaient ainsi rédigées :
[Traduction] 2. QUE le bénéficiaire de l’autorisation paie et acquitte tous les tarifs, droits, taxes, et cotisations qui lui sont présentement et seront par la suite imposés à titre d’occupant de la Réserve, relativement aux ouvrages pendant la durée des droits accordés par la présente.
Le conseil de la bande de Westbank a adopté des règlements administratifs en matière d’évaluation et de taxation en application de l’art. 83 de la Loi sur les Indiens, L.R.C. (1985), ch. I-5, et ses modifications, pour les années d’imposition 1991 à 1995. L’intimée a fait l’objet d’une évaluation et d’une imposition pour ces années mais elle n’a ni interjeté appel des avis, ni payé les taxes exigées. L’appelante a poursuivi l’intimée pour une somme de 124 527, 25 $, soit le montant total des taxes, pénalités et intérêts calculés jusqu’au 30 juin 1995, ainsi que pour les intérêts accumulés par la suite.
L’appelante a déposé une demande pour obtenir un jugement en vertu de la règle 18A. Par voie d’appel incident, l’intimée recherchait le rejet de la réclamation et un jugement déclaratoire. La réclamation de l’appelante visant les taxes impayées et les intérêts a été rejetée. Un appel a également été rejeté.
