The appeal from the judgment of the Court of Appeal for Ontario, Number C70861, 2023 ONCA 450, dated June 23, 2023, heard on January 16, 2025, is allowed with costs throughout. The order of the Court of Appeal and the judgment of the Ontario Superior Court of Justice are set aside and the appellants’ application is allowed. It is declared that the appellants are the fee simple owners of the parcel of land described as Parts 2 and 3 on Plan 66R-23112 registered at the Toronto Land Registry Office. The registrar for the Land Registry division of Toronto is directed to amend the parcel register for PIN 10526-0078 (LT) to include Parts 2 and 3 on Plan 66R-23112. Karakatsanis, Martin, Kasirer and Jamal JJ. dissent.

L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C70861, 2023 ONCA 450, daté du 23 juin 2023, entendu le 16 janvier 2025, est accueilli avec dépens devant toutes les cours. L’ordonnance de la Cour d’appel et le jugement de la Cour supérieure de justice de l’Ontario sont infirmés et la demande des appelants est accueillie. Il est déclaré que les appelants sont les propriétaires en fief simple de la parcelle de terrain décrite comme les parties 2 et 3 sur le Plan 66R‑23112 enregistré au bureau d’enregistrement immobilier de Toronto. Le registrateur de la division du bureau d’enregistrement de Toronto est tenu de modifier le registre de parcelles afin que le PIN 10526-0078 (LT) comprenne les parties 2 et 3 sur le Plan 66R‑23112. Les juges Karakatsanis, Martin, Kasirer et Jamal sont dissidents.
