The appeal is allowed, Arbour J. dissenting. The judgment of the Court of Appeal is set aside, and the trial judge’s conviction of the respondent is restored.
Le pourvoi est accueilli, le juge Arbour est dissidente. Le jugement de la Cour d’appel est annulé et la déclaration de culpabilité prononcée contre l’intimé par le juge du procès est rétablie.

The appeal is dismissed on the constitutional questions. The four-year minimum sentence for criminal negligence causing death while using a firearm does not constitute cruel and unusual punishment. The Court of Appeal’s judgment is affirmed on this ground. However, the trial judge’s order relating to pretrial custody is restored. The appellant is sentenced to three years’ imprisonment for the offence under s. 220(a) of the Criminal Code, established after taking into account the five months’ pre-trial custody. The constitutional questions are answered as follows:
(1) Does s. 220(a) of the Criminal Code infringe the right in s. 12 of the Canadian Charter of Rights and Freedoms not to be subjected to any cruel and unusual treatment or punishment in that it establishes a minimum sentence of four years’ imprisonment for the offence of criminal negligence causing death when a firearm is used in the commission of that offence?
Answer: No. McLachlin and Arbour JJ. would answer no, but only for this offender in the particular circumstances of this case.
(2) If the answer to the first question is yes, is the infringement demonstrably justified in a free and democratic society as a reasonable limit pursuant to s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: Given the answer to the first constitutional question, it is unnecessary to answer this question.
Le pourvoi est rejeté à l’égard des questions constitutionnelles. La peine minimale d’emprisonnement de quatre ans pour négligence criminelle causant la mort par suite de l’usage d’une arme à feu ne constitue pas une peine cruelle et inusitée. L’arrêt de la Cour d’appel est confirmé à cet égard. Cependant, l’ordonnance du juge du procès concernant la période d’incarcération avant le procès est rétablie. L’appelant est condamné à trois ans d’emprisonnement pour l’infraction prévue à l’al. 220a) du Code criminel, peine fixée en tenant compte des cinq mois d’incarcération avant le procès. Les questions constitutionnelles reçoivent les réponses suivantes:
(1) L’alinéa 220a) du Code criminel porte-t-il atteinte au droit à la protection contre tous traitements ou peines cruels et inusités reconnu à l’art. 12 de la Charte canadienne des droits et libertés du fait qu’il prévoit une peine d’emprisonnement minimale de quatre ans pour l’infraction de négligence criminelle causant la mort, s’il y a eu usage d’une arme à feu lors de la perpétration de cette infraction?
Réponse: Non. Les juges McLachlin et Arbour répondraient non, mais seulement dans le cas du délinquant en cause, dans les circonstances particulières de la présente affaire.
(2) Si la réponse à la première question est affirmative, l’atteinte peut-elle se justifier dans le cadre d’une société libre et démocratique à titre de limite raisonnable au sens de l’article premier de la Charte canadienne des droits et libertés?
Réponse: Vu la réponse donnée à la première question constitutionnelle, il n’est pas nécessaire de répondre à cette question.
