1                                   The Chief Justice —  The Court would dismiss the appeal substantially for the reasons of Proulx and Dussault JJ.A. in the Quebec Court of Appeal,  LeBel J. dissenting.  LeBel J. would allow the appeal substantially for the reasons given by Fish J.A. in the Quebec Court of Appeal.

 

2                                   The appeal is dismissed.
