The application for leave to appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA033265, 2007 BCCA 52, dated January 29, 2007, is granted with costs in any event of the cause.   This appeal will be heard with B.M.P. Global Distribution Inc., 636651 B.C. Ltd., Audie Hashka and Paul Backman v. Bank of Nova Scotia and the said Scotiabank (31930).

 

 

                          JUGEMENT

 

La demande dautorisation dappel de larrêt de la Cour dappel de la Colombie‑Britannique (Vancouver), numéro CA033265, 2007 BCCA 52, daté du 29 janvier 2007, est accordée avec dépens quelle que soit lissue de lappel.  Cet appel sera entendu avec Banque de Nouvelle‑Écosse faisant affaire comme Banque Scotia et ledit Banque Scotia c.
