The motion for an extension of time to serve and file the application for leave to appeal is granted.  The application for leave to appeal from the judgment of the Court of Appeal for British Columbia (Victoria), Number CA038015, 2010 BCCA 587, dated December 10, 2010, is dismissed without costs.

 

JUGEMENT
