JUDGMENT

 

The application for an extension of time to serve and file the application for leave to appeal is granted.  The application for leave to appeal from the judgment of the Federal Court of Appeal, Number A-491-09, 2010 FCA 286, dated October 28, 2010, is dismissed with costs.  The request for special costs award is denied.

 

JUGEMENT

 

La demande en prorogation du délai de signification et de dépôt de la demande d’autorisation d’appel est accordée. La demande d’autorisation d’appel de l’arrêt de la Cour d’appel fédérale, numéro A-491-09, 2010 CAF 286, daté du 28 octobre 2010, est rejetée avec dépens. La demande en vue d’obtenir des dépens spéciaux est refusée.
