JUDGMENT

 

The motion for interim costs of the appeal, to vacate the stay of execution and to adduce new evidence on the appeal is dismissed with costs.  The application for leave to appeal from the judgment of the Court of Appeal for Ontario, Number C51659, 2010 ONCA 709, dated October 27, 2010, is dismissed with costs.  The request for  special costs award is denied. 

 

JUGEMENT

 

La requête en vue d’obtenir une provision pour les frais du présent appel, en annulation du sursis d’exécution et en vue de déposer de nouveaux éléments de preuve est rejetée avec dépens. La demande d’autorisation d’appel de l’arrêt de la Cour d’appel de l’Ontario, numéro C51659, 2010 ONCA 709, daté du 27 octobre 2010, est rejetée avec dépens.  La demande en vue d’obtenir des dépens spéciaux est refusée.
