The motion for an order striking out the respondent’s response is dismissed.  The motion for a stay of execution is dismissed.  The application for leave to appeal from the judgment of the Federal Court, Number T-1973-12, dated February 14, 2013, is dismissed with costs.

 

JUGEMENT
