The application for leave to appeal from the judgment of the Court of Appeal for Ontario, Number C56358, 2013 ONCA 388, dated June 12, 2013, is dismissed with costs to the respondent, including costs of the motion for a stay of execution, referred to in the judgment of the Ontario Court of Appeal dated July 26, 2013, on a party and party basis.
