The application for leave to appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 2301-0250A, 2025 ABCA 270, dated July 31, 2025, heard this day, is granted only on the following issue, as agreed by both parties, that is: what mental element must the Crown prove in a sexual assault prosecution where the defence of honest but mistaken belief in communicated consent does not arise, and how should juries be instructed to assess the mental element in issue? |

JUGEMENT
La demande d’autorisation d’appel de l’arrêt de la Cour d’appel de l’Alberta (Calgary), numéro 2301-0250A, 2025 ABCA 270, daté du 31 juillet 2025, entendue aujourd’hui, est accueillie uniquement sur la question suivante, telle que convenue par les deux parties, à savoir : quel élément moral la Couronne doit‑elle établir dans une affaire d’agression sexuelle lorsque la défense de croyance sincère mais erronée au consentement communiqué ne s’applique pas, et quelles directives faut-il donner à un jury pour évaluer l’élément moral en cause? |
