The application for an extension of time and the motion to expedite the application for leave to appeal are granted. The application for leave to appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 0801‑0054‑AC, 2009 ABCA 167, dated May 5, 2009, is dismissed with costs to the Respondents Naturener Energy Canada Inc., Naturener USA LLC and Montana Alberta Tie Ltd.

 

                          JUGEMENT

 

La demande de prorogation de délai et la requête visant à accélérer la procédure de demande dautorisation dappel sont accordées.
