| JUDGMENT
The motion to adduce new evidence and the application for an extension of time to apply for leave to appeal from the judgment of the Court of Appeal for Ontario, Number C48402, 2008 ONCA 695, dated October 8, 2008, are dismissed with costs to the respondent E.Y. In any event, had such application been granted, the application for leave to appeal from the said judgment would have been dismissed.

La requête pour déposer de nouveaux éléments de preuve et la demande de prorogation de délai pour le dépôt d’une demande d’autorisation d’appel de l’arrêt de la Cour d’appel de l’Ontario, numéro C48402, 2008 ONCA 695, daté du 8 octobre 2008, sont rejetées avec dépens en faveur de l’intimée E.Y. Quoi qu’il en soit, même si la demande de prorogation avait été accueillie, la demande d’autorisation d’appel aurait été rejetée.
