| JUDGMENT
The motion to expedite the leave application is dismissed. The application for leave to appeal and the application for leave to cross-appeal from the judgment of the Court of Appeal for Ontario, Numbers C46864 and C45923, 2009 ONCA 59, dated January 26, 2009, are granted. The appeal is to be heard with Canadian Broadcasting Corporation, et al. v. Her Majesty the Queen, et al. (32865) on November 16, 2009.
