JUDGMENT

 

The motion for an extension of time to serve and file the application for leave to appeal is granted. The application for leave to appeal from the judgment of the Court of Appeal of Alberta (Edmonton), Number 1003-0169-AC, 2011 ABCA 281, dated October 5, 2011, is dismissed with costs to the respondent University of Calgary.  The request for special costs award is denied.

 

JUGEMENT

 

La requête en prorogation du délai de signification et de dépôt de la demande d’autorisation d’appel est accueillie. La demande d’autorisation d’appel de l’arrêt de la Cour d’appel de l’Alberta (Edmonton), numéro 1003-0169-AC, 2011 ABCA 281, daté du 5 octobre 2011, est rejetée avec dépens en faveur de l’intimée University of Calgary.  La demande en vue d’obtenir des dépens spéciaux est refusée.
