                         JUDGMENT

Upon considering the application for leave to appeal from the judgment of the Court of Appeal of Alberta (Edmonton), Number 0503‑0003‑AC, 2006 ABCA 41, dated January 31, 2006, the Court orders pursuant to s. 43(1.1) of the Supreme Court Act that the case be and it is hereby remanded to the Court of Appeal to be dealt with in accordance with the decision of this Court in Double N Earthmovers Ltd. v. Edmonton (City), 2007 SCC 3.

                          JUGEMENT

Après examen de la demande d’autorisation d’appel de l’arrêt de la Cour d’appel de l’Alberta (Edmonton), numéro 0503‑0003‑AC, 2006 ABCA 41, daté du 31 janvier 2006, la Cour ordonne, en vertu du par. 43(1.1) de la Loi sur la Cour suprême, que l’affaire soit renvoyée à la Cour d’appel pour qu’elle statue en fonction de l’arrêt de la Cour Double N Earthmovers Ltd. c. Edmonton (Ville), 2007 CSC 3.
