                         JUDGMENT

The motions for an extension of time to serve and file the application for leave to appeal and to file a lengthy memorandum of argument are granted. The request for an oral hearing of the application for leave to appeal from the judgment of the Court of Appeal for Ontario, Number C48318, 2009 ONCA 742, dated October 28, 2009, is granted. The hearing is scheduled for April 12, 2010.
