| JUDGMENT
The application for leave to appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA032160, 2006 BCCA 277, dated June 8, 2006, is granted. The application of the Tsawwassen First Nation for leave to intervene in the leave application is to be treated as a motion for intervention in the appeal itself and deferred to be dealt with in due course without any need for a refiling of the material, without prejudice to the right of the Tsawwassen First Nation to file such further and other material on its motion to intervene as it deems appropriate and this Court permits.

JUGEMENT
La demande d’autorisation d’appel de l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA032160, 2006 BCCA 277, daté du 8 juin 2006, est accordée. La demande présentée par la Première nation Tsawwassen en vue d’intervenir dans la demande d’autorisation d’appel sera traitée comme une requête en autorisation d’intervenir dans l’appel même et sera examinée en temps utile, sans qu’il soit nécessaire que les documents soient déposés à nouveau et sans préjudice du droit de la Première nation Tsawwassen de déposer d’autres documents relativement à sa requête en intervention si elle le juge opportun et si la Cour l’y autorise.
