The application for an extension of time is granted and the application for leave to appeal from the judgment of the Court of Appeal of Quebec (Québec), Number 200‐10‐001850‐069, dated June 22, 2007, is dismissed.
CASE SUMMARY
Criminal law - Appeal - Court of Appeal holding that Applicant’s appeal was frivolous and that it could be determined without being adjourned for full hearing - Whether Court of Appeal erred in law by violating principle of fundamental justice, namely, right to appeal - Whether Court of Appeal erred in law by violating principle of fundamental justice, namely, party’s right to be present at hearing of own case - Whether Court of Appeal exceeded authority after misinterpreting s. 685 of Criminal Code.
Mr. Rudnicki was convicted of uttering a threat to burn, destroy or damage real property (s. 264.1(1)(b) and (3)(a) Cr.C.), uttering a threat to cause death or bodily harm to employees of an institution (s. 264.1(1)(a) and (2)(a) Cr.C.), committing mischief in relation to property the value of which did not exceed $5,000 (s. 430(1)(a) and (4)(a) Cr.C.) and failing to comply with a condition of his recognizance (s. 811 Cr.C.). Dutil J.A. refused leave to bring an appeal out of time from the verdicts and sentences on the basis that the grounds of appeal were unfounded and that it was not in the interests of justice to allow the appeal. Mr. Rudnicki’s applications for leave to appeal that judgment of the Court of Appeal were dismissed by the Supreme Court of Canada. The Applicant’s subsequent notice of appeal from the conviction, which was dated December 14, 2006, was referred by the clerk to the Court of Appeal for summary determination in accordance with s. 685 of the Criminal Code on the basis that the notice of appeal did not show a substantial ground of appeal.

M. Rudnicki a été trouvé coupable d’avoir proféré une menace de brûler, détruire ou endommager un immeuble (art. 264.1(1)b)et(3)a) C.cr.), d’avoir proféré une menace de causer la mort ou des lésions corporelles à des employés d'une entreprise (art. 264.1 (1)a) et (2)a) C.cr.), de méfait sur un bien d’une valeur ne dépassant pas 5 000 $ (art. 430(1)a) et (4)a) C.cr.) et d'avoir omis de se conformer à une condition de son engagement (art. 811 C.cr.). La juge Dutil de la Cour d’appel a refusé la permission d’en appeler hors délai des verdicts et des peines, au motif que les moyens d’appel étaient mal fondés et qu’il n’était pas dans l’intérêt de la justice de permettre les recours. Les demandes d’autorisation d’appel de M. Rudnicki de ce jugement de la Cour d’appel sont rejetées par la Cour suprême du Canada .L’avis d’appel subséquent du demandeur de la condamnation,daté du 14 décembre 2006, est renvoyé devant la Cour d’appel par la greffière conformément à l’article 685 du Code criminel, en vue d’une décision sommaire, celle-ci estimant que l’avis d’appel n’énonce pas un motif d’appel sérieux.

Mr. Rudnicki was convicted of uttering a threat to burn, destroy or damage real property (s. 264.1(1)(b) and (3)(a) Cr.C.), uttering a threat to cause death or bodily harm to employees of an institution (s. 264.1(1)(a) and (2)(a) Cr.C.), committing mischief in relation to property the value of which did not exceed $5,000 (s. 430(1)(a) and (4)(a) Cr.C.) and failing to comply with a condition of his recognizance (s. 811 Cr.C.). Dutil J.A. refused leave to bring an appeal out of time from the verdicts and sentences on the basis that the grounds of appeal were unfounded and that it was not in the interests of justice to allow the appeal. Mr. Rudnicki’s applications for leave to appeal that judgment of the Court of Appeal were dismissed by the Supreme Court of Canada. The Applicant’s subsequent notice of appeal from the conviction, which was dated December 14, 2006, was referred by the clerk to the Court of Appeal for summary determination in accordance with s. 685 of the Criminal Code on the basis that the notice of appeal did not show a substantial ground of appeal.

Rudnicki a été trouvé coupable d’avoir proféré une menace de brûler, détruire ou endommager un immeuble (art. 264.1(1)b) et (3)a) C.cr.), d’avoir proféré une menace de causer la mort ou des lésions corporelles à des employés d'une entreprise (art. 264.1 (1)a) et (2)a) C.cr.), de méfait sur un bien d’une valeur ne dépassant pas 5 000 $ (art. 430(1)a) et (4)a) C.cr.) et d'avoir omis de se conformer à une condition de son engagement (art. 811 C.cr.). La juge Dutil de la Cour d’appel a refusé la permission d’en appeler hors délai des verdicts et des peines, au motif que les moyens d’appel étaient mal fondés et qu’il n’était pas dans l’intérêt de la justice de permettre les recours. Les demandes d’autorisation d’appel de M. Since 2003, the RAMQ has been pursuing a claim against the Applicant for several million dollars in connection with kickbacks paid to pharmacists for the sale of generic drugs. The Applicant has contested this proceeding by means of a number of preliminary exceptions and is currently disputing the right of the Attorney General, as an intervener as of right in this proceeding, to take part in a pre‐trial meeting. The Superior Court and the Court of Appeal dismissed the objection.

In 2000, at a time when the Respondent, Ford, was reducing the number of its automobile dealerships and was taking measures to monitor claims by those dealerships, a dispute arose between the parties regarding certain claims made to the manufacturer by Duclos. Their discussions about inspection procedures and the arbitration process ended in deadlock. On January 29, 2001, Ford sent a notice of resiliation of their agreement pursuant to clause 17(b)(2), which provided that the manufacturer could resiliate the agreement upon 15 days’ notice should a false or fraudulent claim be made. Duclos sought to have the notice quashed and also claimed both payment of any repair work orders that remained unpaid and damages; Ford asked the court to declare the agreement to be resiliated and also claimed damages. The Superior Court quashed the notice of resiliation on the basis that clause 17(b)(2) was abusive; it granted reimbursement of most of the work orders. The Court of Appeal reversed that decision on the basis that the clause in question was not abusive.

En 2000, dans un contexte où l’intimée Ford réduit le nombre de ses concessionnaires automobiles et instaure des mesures de contrôle de leurs réclamations, un différend survient entre les parties quant à certaines réclamations adressées au fabricant par Duclos. Une impasse survient quant aux procédures d’inspection et au processus d’arbitrage. Le 29 janvier 2001, Ford expédie un avis de résiliation de l’entente en invoquant la clause 17 b) 2), selon laquelle toute réclamation fausse ou frauduleuse permet au fabricant de résilier à quinze jours d’avis. Duclos demande l’annulation de cet avis, réclame le paiement des bons de réparation restés impayés ainsi que des dommages-intérêts; Ford demande au tribunal de déclarer la résiliation et réclame des dommages-intérêts. La Cour supérieure annule l’avis de résiliation au motif que la clause 17 b) 2) est abusive; elle accorde le remboursement de la plupart des réparations. La Cour d’appel renverse cette décision au motif que la clause en litige n’est pas abusive.

In December 2000, Ms. Carrington suffered a lumbar sprain while looking after a patient. The CSST recognized the employment injury and then, in January 2002, it extended her eligibility for the plan. Her employer, the Jewish Eldercare Centre, appealed those decisions to the CLP. On October 24, 2002, the scheduled hearing date, counsel met with a conciliator and reached an agreement that there was no employment injury; the hearing did not take place. On November 18, 2002, the CSST filed a notice of intervention. A few months later, as the employee had not yet signed the written agreement, the employer filed a motion to have the agreement confirmed. The case was re-entered on the roll. On April 16, 2003, the scheduled hearing date, counsel met and the employee signed the agreement. The CSST asked to be heard, but the CLP confirmed the agreement without hearing it. The CSST applied for a review, but the CLP dismissed the application. The Superior Court refused to intervene, and the Court of Appeal affirmed that decision.

En décembre 2000, Mme Carrington subit une entorse lombaire alors qu’elle s’occupe d’un patient. La CSST reconnaît la lésion professionnelle puis, en janvier 2002, prolonge l’admissibilité au régime. Le CHSLD Juif de Montréal, employeur, conteste ces décisions devant la CLP. Le 24 octobre 2002, jour prévu pour l’audition, les avocats voient un conciliateur et concluent une entente selon laquelle il n’y a pas eu de lésion professionnelle; l’audition n’a pas lieu. Le 18 novembre 2002, la CSST dépose un avis d’intervention. Après plusieurs mois, l’entente écrite n’étant toujours pas signée par l’employée, l’employeur dépose une requête pour la faire entériner. On remet l’affaire au rôle. Le 16 avril 2003, jour prévu pour l’audition, les avocats se rencontrent et l’employée signe l’entente. La CSST demande à être entendue mais la CLP entérine l’entente sans le faire. La CSST se pourvoit en révision mais la CLP rejette sa requête. La Cour supérieure refuse d’intervenir et la Cour d’appel confirme cette décision.

The Applicant is the owner of a building in Oshawa that was inspected by the city by‐law enforcement officer in response to complaints received that it was an apartment building, in contravention of a zoning by‐law prohibiting apartment buildings in that area. An apartment building was defined as a building with three or more dwelling units. A dwelling unit is defined in the by‐law as “a unit consisting of one or more rooms, which unit contains a toilet, and cooking facilities and which is designed for use as a single house keeping establishment”. The zoning officer concluded that the building contained three dwelling units. She determined that a second floor unit which contained a kitchen, living room, two bathrooms and two occupied bedrooms was designed for use as a single household establishment. The two bedrooms were occupied by two tenants, whose bedrooms were individually locked. The Applicant was charged with using the building as an apartment building. Before the justice of the peace, it was agreed that there were two dwelling units on the main floor and the issue concerned the nature of the second floor unit.

RÉSUMÉ DE L’AFFAIRE
Tribunaux ‐ Juges ‐ La Cour d’appel a-t-elle privé le demandeur de son droit à la justice fondamentale garanti par la Charte canadienne des droits et libertés, y compris le droit d’être entendu par un décideur impartial? ‐ Le demandeur peut-il faire valoir n’importe quel argument en sa défense et non pas seulement l’argument accordé dans l’autorisation d’appel? ‐ La Cour d’appel de l’Ontario, de juridiction inférieure, a-t-elle passé outre à la position établie de la Cour suprême du Canada?
Le demandeur est propriétaire d’un immeuble à Oshawa qui a été inspecté par une agente municipale chargée de l’application des règlements à la suite de plaintes reçues selon lesquelles il s’agissait d’un immeuble d’habitation, en contravention au règlement de zonage qui interdisait les immeubles d’habitation dans ce secteur. Un immeuble d’habitation était défini comme un immeuble qui comprenait trois unités d’habitation ou plus. Une unité d’habitation était définie dans le règlement comme « une unité comprenant une ou plusieurs pièces et qui renfermait une toilette et des installations de cuisine, conçue pour être utilisée comme un logement unifamilial ». L’agente de zonage a conclu que l’immeuble comprenait trois unités d’habitation. Elle a jugé qu’une unité à l’étage, qui renfermait une cuisine, un salon, deux salles de bain et deux chambres occupées, était conçue pour être utilisée comme un logement unifamilial. Les deux chambres étaient occupées par deux locataires et chacune des chambres était verrouillée individuellement. Le demandeur a été accusé d’avoir utilisé l’immeuble comme immeuble d’habitation. Devant le juge de paix, les parties ont reconnu qu’il y avait deux unités d’habitation au rez-de-chaussée et la question en litige portait sur la nature de l’unité à l’étage.

CASE SUMMARY
Charter of Rights - Right to be tried within a reasonable time - Crown and institutional delay - Whether the Court of Appeal erred in finding that the Applicant was tried within a reasonable time.
In 1998, Mr. Horgan was charged with one count of theft over $1,000 based on an allegation that he had deliberately failed to notify Sun Life of the death of one of its annuitants in order to collect money to which he knew he was not entitled. However, because he was hospitalized for depression, he was not arrested until February 1999. Initial Crown disclosure was provided in July 1999. Several attorneys appeared on behalf of the Crown and on behalf of Mr. Horgan. Mr. Horgan’s defence counsel requested further disclosure in December 1999 and March 2000. By letter dated March 8, 2000, that further disclosure was refused.
The preliminary inquiry began in October 2001. It was scheduled to run October 2, 5 and 9, but the trial judge was unavailable on the first day. It began on October 5, but was interrupted for an unrelated matter. Defence counsel was not available on October 9, and, anticipating that the inquiry would not be very long, he waived any s. 11(b) delay until the inquiry was concluded. The inquiry resumed in January 2002, but defence counsel and the judge both had medical appointments, so it was adjourned, first until May 14, when there was an interruption for an in‐custody trial, and then because defence counsel found the courtroom “awfully hot”. The inquiry resumed in September 2002, when there were discussions about converting the inquiry into a trial. It was further adjourned. The defence does not take issue with any subsequent delay. The inquiry concluded in March 2003, when Mr. Horgan consented to committal.
Before the applications judge, the Crown agreed with the defence that only three and one half months of that delay should be attributed to the defence (October 2001 to January 2002). The s. 11(b) application was heard and dismissed in February 2004, and trial commenced and concluded in the fall of 2004. After the trial concluded, Mr. Horgan brought an unsuccessful application to re‐open the trial and seek a stay of proceedings for abuse of process. In November 2005, following failure of that application, Mr. Horgan was sentenced to a conditional sentence of two years less a day. The Court of Appeal denied Mr. Horgan’s appeal.

Charte des droits - Procès dans un délai raisonnable - Ministère public et délai institutionnel - La Cour d’appel a-t-elle eu tort de conclure que le demandeur avait subi son procès dans un délai raisonnable?
En 1998, M. Horgan a été accusé relativement à un chef de vol de plus de 1 000 $ sur le fondement d’une allégation qu’il avait délibérément omis d’aviser la Sun Life du décès d’une de ses rentières pour pouvoir percevoir de l’argent auquel il savait ne pas avoir droit. Toutefois, parce qu’il avait été hospitalisé en raison d’une dépression, il n’a été arrêté qu’en février 1999. La communication initiale de la preuve par le ministère public a été faite en juillet 1999. Plusieurs avocats ont comparu pour le ministère public et M. Horgan. L’avocat de la défense de M. Horgan a demandé la communication d’éléments de preuve additionnels en décembre 1999 et en mars 2000. Par lettre en date du 8 mars 2000, cette communication a été refusée.
L’enquête préliminaire a débuté en octobre 2001. Elle devait avoir lieu les 2, 5 et 9 octobre, mais le juge qui devait présider n’était pas disponible le premier jour. L’enquête a débuté le 5 octobre, mais a été interrompue pour une question sans rapport avec l’instance. L’avocat de la défense n’était pas disponible le 9 octobre et, prévoyant que l’enquête ne serait pas très longue, il a renoncé à présenter toute requête fondée sur l’al. 11 b) jusqu’à la clôture de l’enquête. L’enquête a repris en janvier 2002, mais l’avocat de la défense et le juge avaient tous les deux des rendez-vous chez le médecin, ce qui a amené l’ajournement, d’abord jusqu’au 14 mai, où il y a eu une interruption pour un procès sous garde, puis parce que l’avocat de la défense trouvait qu’il faisait très chaud dans la salle d’audience. L’enquête a repris en septembre 2002, où il y a eu des discussions sur la possibilité de convertir l’enquête en procès. L’enquête a été ajournée de nouveau. L’avocat de la défense ne s’est pas plaint des délais subséquents. L’enquête a pris fin en mars 2003, où M. Horgan a consenti à l’incarcération.
Devant le juge des requêtes, le ministère public s’est dit d’accord avec la défense pour dire que seulement trois mois et demi de ce délai devaient être attribués à la défense (d’octobre 2001 à janvier 2002). La requête fondée sur l’al. 11 b) a été entendue et rejetée en février 2004 et le procès a commencé et pris fin à l’automne 2004. Après le procès, M. Horgan a présenté sans succès une requête pour la réouverture du procès et un arrêt des procédures pour abus de procédure. En novembre 2005, à la suite du rejet de cette requête, M. Horgan a été condamné à une peine avec sursis de deux ans moins un jour. La Cour d’appel a rejeté l’appel de M. Horgan.

In February 2007, Ms. Bérubé asked the Superior Court to declare that the Quebec government was illegally and fraudulently operating video lottery terminals through the Loto-Québec corporation and that the revenues generated by those terminals constituted indirect taxes, and sought an injunction in this regard, as well as damages for alleged inconvenience, consequences and financial losses. She also asked for a declaration to the effect that an agreement [translation] “on gambling establishments” entered into by, among others, the Attorney General of Quebec and Groupe attractions hippiques, of which Senator Paul J. Massicotte is alleged to be the sole shareholder, was illegal, immoral and unconstitutional, and sought cessation of the operation of video lottery terminals at racetracks.
The Attorney General and Mr. Massicotte each filed a motion to dismiss against Ms. Bérubé’s motion to institute proceedings, arguing that her motion was unfounded in law and that the matter was res judicata, given that the Superior Court had dismissed a motion for declaratory judgment made by Ms. Bérubé in Bérubé v. Loto-Québec (Sup. Ct. Hull, 550-17-001741-055, April 4, 2005, aff’d August 10, 2005, C.A. Montréal, application for leave to appeal to Supreme Court of Canada dismissed, file No. 31158, February 16, 2006).
The Superior Court allowed both motions to dismiss. The Court of Appeal dismissed Ms. Bérubé’s appeals on the basis that they had no reasonable chance of success.

En février 2007, Mme Bérubé demande à la Cour supérieure de déclarer que les appareils de loterie vidéo exploités par le gouvernement du Québec par le truchement de la société Loto-Québec opèrent illégalement et frauduleusement, que les revenus générés par ces appareils constituent des taxes indirectes, et réclame une injonction en ce sens, de même que des dommages-intérêts pour compenser les inconvénients, séquelles et pertes financières qu’elle aurait subis. Elle demande aussi une déclaration à l’effet qu’une entente « concernant les maisons de jeu » intervenue entre, notamment, le procureur général du Québec et le Groupe attractions hippiques, dont le sénateur Paul J. Massicotte serait le seul actionnaire, est illégale, immorale et inconstitutionnelle, et demande l’arrêt des opérations des appareils de loterie vidéo dans les hippodromes.
Le procureur général et M. Massicotte présentent chacun une requête en irrecevabilité à l’encontre de la demande introductive d’instance de Mme Bérubé, alléguant que la demande est non fondée en droit et qu’il y a chose jugée vu le jugement de la Cour supérieure ayant rejeté une requête de Mme Bérubé en jugement déclaratoire dans le dossier Bérubé c. Loto-Québec (C. S. Hull, 550-17-001741-055, 4 avril 2005, conf. le 10 août 2005, C. A. Montréal, demande d’autorisation d’appel à la Cour suprême du Canada rejetée, dossier no 31158, 16 février 2006).
La Cour supérieure accueille les deux requêtes en irrecevabilité. La Cour d’appel rejette les appels de Mme Bérubé au motif que ceux-ci n’ont aucune chance raisonnable de succès.

The appeal from the judgment of the Federal Court of Appeal, Number A‐527‐05, 2006 FCA 196, dated May 25, 2006, heard on October 17, 2007, is allowed. Section 20(2) of the Canadian Charter of Rights and Freedoms requires the Royal Canadian Mounted Police to provide services in both official languages when acting as a provincial police force pursuant to the agreement between the New Brunswick government and the Government of Canada dated April 1, 1992. En vertu d’une entente conclue par le Canada et le Nouveau‐Brunswick, la GRC, une institution fédérale, joue le rôle de service de police provincial dans cette province. Le présent pourvoi vise à déterminer si les membres de la GRC sont tenus de respecter les obligations linguistiques imposées aux institutions du Nouveau‐Brunswick par le par. 20(2) de la Charte canadienne des droits et libertés lorsqu’ils exercent leurs fonctions en tant qu’agents de police provinciaux. La Cour fédérale a conclu que la fonction de police provinciale qui est remplie par la GRC fait de celle‐ci une institution du Nouveau‐Brunswick pour l’application du par. 20(2) et que la GRC est donc tenue de fournir des services de police conformément aux normes linguistiques provinciales. La Cour d’appel fédérale a cassé ce jugement.
Arrêt : Le pourvoi est accueilli.
Le paragraphe 20(2) de la Charte oblige la GRC à fournir ses services dans les deux langues officielles lorsqu’elle exerce au Nouveau‐Brunswick le rôle d’un service de police provincial aux termes de l’entente. La GRC conserve le statut d’institution fédérale lorsqu’elle agit en vertu d’un contrat avec une province. Toutefois, comme chaque membre de la GRC se voit conférer, en vertu du par. 2(2) de la Loi sur la Police du Nouveau‐Brunswick, toutes les attributions d’un agent de la paix de la province et qu’il est habilité par cette province à y administrer la justice, il exerce alors le rôle d’une « institution de la législature ou du gouvernement » du Nouveau‐Brunswick et il est tenu de respecter le par. 20(2) de la Charte. Il ne s’agit pas d’un transfert de responsabilité à l’égard de l’administration de la justice dans la province. En vertu de l’entente, le Nouveau‐Brunswick garde la maîtrise des activités de police de la GRC. Le ministre de la Justice provincial remplit ses obligations constitutionnelles par l’entremise des membres de la GRC que la loi provinciale désigne comme agents de la paix du Nouveau‐Brunswick. En conséquence, la GRC n’agit pas comme institution fédérale distincte pour administrer la justice au Nouveau‐Brunswick; elle assume par contrat les obligations qui sont reliées à la fonction de service de police précisée dans les lois provinciales. De plus, les fonctions prises en charge par la GRC sont des fonctions gouvernementales assujetties à des obligations constitutionnelles spécifiques. La GRC ne peut assumer ces fonctions sans assumer les obligations qui s’y rattachent. C’est donc par le biais de l’entente, en participant à une fonction gouvernementale du Nouveau‐Brunswick, que la GRC se voit imposer des obligations constitutionnelles en vertu du par. 20(2) de la Charte. Under an agreement between Canada and New Brunswick, the RCMP, a federal institution, acts as a provincial police force in that province. The issue in this appeal is whether RCMP members are required, when performing their duties as provincial police officers, to fulfil the language obligations imposed on New Brunswick institutions by s. 20(2) of the Canadian Charter of Rights and Freedoms. The Federal Court held that serving as a provincial police force makes the RCMP a New Brunswick institution for the purposes of s. 20(2) and that the RCMP is therefore required to provide police services in accordance with the provincial language standards. The Federal Court of Appeal set aside that judgment.
Held: The appeal should be allowed.
Section 20(2) of the Charter requires the RCMP to provide services in both official languages when acting as a provincial police force in New Brunswick pursuant to the agreement. The RCMP retains its status as a federal institution when it acts under a contract with a province. However, since each RCMP member has, under s. 2(2) of the New Brunswick Police Act, all the attributes of a provincial peace officer and is authorized by that province to administer justice there, he or she performs the role of an “institution of the legislature or government” of New Brunswick and must comply with s. 20(2) of the Charter. There is no transfer of responsibility for the administration of justice in the province. Under the agreement, New Brunswick retains control over the RCMP’s policing activities. The provincial Minister of Justice discharges his or her constitutional obligations through the RCMP members designated as New Brunswick peace officers by the provincial legislation. Consequently, the RCMP does not act as a separate federal institution in administering justice in New Brunswick; it assumes, by way of contract, obligations related to the police service function set out in the provincial legislation. Furthermore, the functions for which the RCMP is responsible are government functions that are subject to specific constitutional obligations. The RCMP may not take on such functions without assuming the obligations associated with them. Thus, it is as a result of the agreement that the RCMP, by participating in a function of the New Brunswick government, has constitutional obligations imposed on it under s. 20(2) of the Charter.
