Criminal and Penal Law - Offences - Elements of Offence - Dangerous Operation of Motor Vehicle - Whether British Columbia Court of Appeal has created a presumption that any accident caused by the negligence of a driver will result in a conviction for dangerous driving unless the driver can provide an explanation for the manner in which the vehicle was operated - Application of R. v. Hundal, [1993] 1 S.C.R. 867 - Criminal Code, R.S.C. 1985, c. C-46, s. 249.
On July 23, 2003, the Appellant caused a head-on collision killing three occupants in another car. His pick-up truck crossed into the on-coming lane of traffic when it should have curved into a turn in the highway. A collision analyst estimated that his truck travelled about one metre in the wrong lane before impact and the sequence of events occurred in 0.00268 of a second. The accident occurred on a sunny day. The highway was dry, bare and in good condition. Both cars were travelling at the speed limit. There was no evidence of drunk driving, vehicle failure, evasive measures by either driver, or speeding. Witnesses testified that the Appellant was driving with care and control before the collision occurred. They stated the accident occurred “instantaneously” and in “a matter of seconds”. Immediately after the accident, the Appellant was stunned. He alternately said that he was driving and went unconscious, he thought he had suffered heat stroke, and he thought he had fallen asleep. He did not appear to comprehend some questions and could not remember how the accident had occurred. The Appellant was charged with three counts of dangerous driving causing death. The Appellant was acquitted of all three charges. On appeal, the Crown’s appeal was allowed, the acquittals were set aside and a new trial ordered.

Droit criminel et pénal - Infractions - Éléments de l’infraction - Conduite dangereuse d’un véhicule à moteur - La Cour d’appel de la Colombie‑Britannique a‑t‑elle créé une présomption voulant que tout accident causé par la négligence d’un conducteur entraîne une déclaration de culpabilité pour conduite dangereuse à moins que le conducteur fournisse des explications quant à sa façon de conduire le véhicule? - Application de R. c. Hundal, [1993] 1 R.C.S. 867 - Code criminel, L.R.C. 1985, ch. C-46, art. 249.
Le 23 juillet 2003, l’appelant a causé une collision frontale, tuant les trois occupants d’un autre véhicule. Sa camionnette a débordé sur la voie inverse dans un virage sur l’autoroute. Un analyste des collisions a estimé que la camionnette empiétait d’environ un mètre sur la mauvaise voie avant l’impact et que les événements se sont produits en 0.00268 seconde. Il faisait soleil lorsque l’accident est arrivé. La chaussée était sèche, dégagée et en bon état. Les deux véhicules circulaient à la vitesse limite. Il n’existait aucune preuve de conduite en état d’ébriété, de bris de véhicule, de man_uvres d’évitement tentées par l’un ou l’autre des conducteurs ou de vitesse excessive. Les témoins ont déclaré que l’appelant conduisait avec prudence et maîtrise avant la collision. Selon eux, l’accident est survenu « instantanément » et « en quelques secondes ». Immédiatement après l’accident, l’appelant, sous le choc, a tour à tour affirmé qu’il avait perdu conscience au volant, qu’il croyait avoir souffert d’un coup de chaleur et qu’il croyait s’être endormi. Il a semblé ne pas comprendre certaines questions et ne pouvait se souvenir des circonstances de l’accident. L’appelant a été inculpé de trois infractions de conduite dangereuse ayant causé la mort. Il a été acquitté des trois chefs d’accusation. L’appel formé par la Couronne a été accueilli, les acquittements ont été annulés et un nouveau procès a été ordonné.
