Torts - Negligence - Duty of care - Recovery for pure economic loss - Tendering process - Whether Respondent owed Appellant subcontractors duty of care in tort not to award contract to a non-compliant bidder.
A general contractor, together with its architect and certain consultants and subcontractors (the Appellants), launched litigation against the Respondent after Public Works and Government Services Canada decided to award the contract for the construction of a naval reserve building in St. John's, Newfoundland to another bid proponent. The general contractor, having reached a settlement with the Respondent, discontinued its action. The parties agreed that the trial judge should proceed on the assumption that the plaintiff general contractor should have won the contract. Against that factual background, the trial judge determined that the Respondent owed the Appellants a duty of care in tort not to award the contract to a non-compliant bidder. The Court of Appeal allowed the Respondent’s appeal of that decision.

Responsabilité délictuelle - Négligence - Obligation de diligence - Indemnisation d’une perte purement économique - Processus d’appel d’offres - L’intimée avait‑elle envers les sous‑traitants appelants une obligation de diligence en matière délictuelle l’empêchant d’attribuer le contrat à un soumissionnaire non conforme?
Un entrepreneur général, ainsi que son architecte et certains consultants et sous‑traitants (les appelants), ont intenté un procès contre l’intimée après que Travaux publics et Services gouvernementaux Canada eut décidé d’attribuer à un autre soumissionnaire le contrat de construction d’un édifice de la Réserve navale de St. John's, à Terre‑Neuve. Après avoir conclu une entente avec l’intimée, l’entrepreneur général s’est désisté de son action. Les parties ont convenu que le juge de première instance devait tenir pour acquis que l’entrepreneur général demandeur aurait dû obtenir le contrat. Compte tenu de ces faits, le juge de première instance a décidé que l’intimée avait envers les appelants une obligation de diligence en matière délictuelle l’empêchant d’attribuer le contrat à un soumissionnaire non conforme. La Cour d’appel a accueilli l’appel interjeté par l’intimée contre cette décision.

International Law - Public international law - Extradition - Charter of Rights (Criminal) - Mobility Rights - Standard of review of Minister’s decisions on Charter issues in surrender proceedings - Sufficiency of Minister’s reasons for ordering surrender - Whether Appellant’s surrender infringed Canadian Charter of Rights and Freedoms.
The Appellant made an offer to sell crack cocaine to an undercover Ontario Provincial Police officer in Windsor, Ontario. The sale occurred in Detroit, Michigan. The Appellant sold the officer 99.2 grams of crack cocaine. Lake was convicted and imprisoned in Canada for offences including conspiracy to traffic in cocaine but not the offence of trafficking. The United States requested the Appellant’s extradition to face a charge of unlawful distribution of crack cocaine in Michigan, which carries a minimum sentence of ten years imprisonment. The Appellant was ordered to be committed. The Minister ordered his surrender and, in doing so, dismissed arguments raised by the Appellant including arguments based on the Canadian Charter of Rights and Freedoms. On appeal, the Court of Appeal dismissed the application for judicial review of the surrender order.

À Windsor, en Ontario, l’appelant a offert de vendre de la cocaïne épurée (crack) à un agent d’infiltration de la Police provinciale de l’Ontario. La vente a eu lieu à Détroit, au Michigan. L’appelant a vendu 99,2 grammes de crack à l’agent. Monsieur Lake a été déclaré coupable et emprisonné au Canada relativement à des infractions comprenant celle de complot en vue de faire le trafic de cocaïne, mais pas celle de trafic. Les États‑Unis ont demandé son extradition pour qu’il réponde à une accusation de distribution illégale de crack au Michigan, infraction passible d’une peine minimale de dix ans d’emprisonnement. On a ordonné l’incarcération de l’appelant. Le ministre a ordonné l’extradition de celui-ci et, ce faisant, a rejeté les arguments qu’il avait soulevés, y compris ceux fondés sur la Charte canadienne des droits et libertés. La Cour d’appel a rejeté la demande de contrôle judiciaire de l’arrêté d’extradition.

Criminal law – Appeals – Evidence – Sufficient reasons – Conflicting testimony – Credibility – Whether sufficient reasons given for trial judge’s decision – Whether, in light of principles from R. v. W.(D.), [1991] 1 S.C.R. 742, trial judge erred in analysis regarding credibility of accused.
Jean Dinardo is a taxi driver. On September 8, 2004, he went for the first time to the residence of the complainant, a young woman with a mild mental disability, to drive her to a youth centre (Maison des jeunes) for daytime activities. According to the victim, Dinardo assaulted her during the trip, but he denied having done so.
The trial judge considered the complainant’s version to be credible. The accused appealed his conviction, but the appeal was dismissed. Chamberland J.A., in dissent, would have ordered a new trial.

W.(D.), [1991] 1 R.C.S. 742, le juge du procès a-t-il commis une erreur dans l’analyse de la crédibilité de l’accusé?
Jean Dinardo est chauffeur de taxi. Le 8 septembre 2004, il se rend pour la première fois à la résidence de la plaignante, une jeune femme atteinte d’une légère déficience mentale, afin de la conduire à une Maison des jeunes pour des activités de jour. La victime déclare avoir été agressée par Dinardo lors du trajet. Ce dernier nie.
Le juge de première instance considère que la version de la plaignante est crédible. Le pourvoi en appel de l’accusé contre sa condamnation est rejeté. Le juge Chamberland, dissident, aurait ordonné un nouveau procès.
