Charte des droits ‑ Droit constitutionnel ‑ Liberté de religion ‑ Équité procédurale ‑ Droit à l’égalité ‑ Discrimination fondée sur l’âge ‑ Justice fondamentale ‑ Droit de refuser un traitement médical ‑ Opposition par des parents pour des motifs religieux à l’administration d’une transfusion sanguine à leur enfant ‑ Ordonnance déclarant que l’enfant a besoin de protection ‑ Transfusion sanguine administrée à l’enfant ‑ Les dispositions de la Loi sur les services à l’enfant et à la famille, C.P.L.M. c. C80 sont‑elles inconstitutionnelles pour le motif qu’elles porteraient atteinte aux droits garantis à l’enfant par l’al. 2a), l’art. 7 et le par. 15(1) de la Charte? ‑ Dans l’affirmative, l’atteinte est‑elle justifiée en tant que limite raisonnable? ‑ Est‑ce la capacité du patient concerné ou un âge arbitraire fixé par un texte de loi qui devrait déterminer l’application du droit garanti par la Charte à un patient capable de prendre des décisions en matière de traitement médical? ‑ L’article premier de la Charte oblige‑t‑il l’État à présenter une preuve convaincante pour justifier un texte de loi qui fixe un âge arbitraire et permet d’écarter les décisions prises par un patient capable en matière de traitement médical? ‑ La juridiction inférieure a‑t‑elle eu tort de prendre connaissance d’office d’une preuve qu’elle a consultée de son propre chef? ‑ L’État a‑t‑il omis de présenter une preuve forte et convaincante justifiant les violations de la Charte? ‑ L’application du droit garanti par la Charte à un patient capable de prendre des décisions en matière de traitement médical dépend‑elle de la province ou du territoire de résidence de ce patient? ‑ Loi sur les services à l’enfant et à la famille, C.P.L.M. c. C80, art. 25 ‑ Charte canadienne des droits et libertés, art.1, 2a), 7, 15(1).
