JUDGMENT

The motions for an extension of time to serve and file the application for leave to appeal and the applicant’s reply are granted. The application for leave to appeal from the judgments of the Federal Court of Appeal, Number A-225-11, dated August 15, 2011 and September 12, 2011, is dismissed with costs to the respondents Her Majesty the Queen in Right of Alberta, Alberta Ministry of Justice, Alberta Ministry of Health, Canadian National Railway Co. and Fraser Milner Casgrain LLP.

JUGEMENT
